Profit Zurich AG (“Profit Zurich”, “we”, “us”) takes the protection of your personal data seriously. This Privacy Policy explains which personal data we process when you visit our website www.profit-zurich.ch (the “Website”), for what purposes, where such data is stored and what rights you have. It also provides information on the use of cookies.

We process personal data in accordance with the Swiss Federal Act on Data Protection (FADP) and, where applicable, the EU General Data Protection Regulation (GDPR).

Scope

This Privacy Policy applies to the use of our Website. It does not apply to third-party websites accessible via links. We will inform you separately about the processing of personal data in the context of a client relationship.

What data we process

When you visit the Website: For technical reasons, certain data is automatically recorded in server log files when the Website is accessed. This includes the IP address, the date and time of access, the page accessed, the previously visited page and information about the browser and operating system. We use this data solely to provide the Website and to ensure its security and stability. We do not attribute this data to any specific individual.

When you contact us: If you contact us via the contact form, by email or by telephone, we process the information you provide to us. In the case of the contact form, this includes in particular your name, email address, telephone number, the selected subject, your message and your confirmation that you have read this Privacy Policy. Please do not use the contact form to send us confidential information about your financial circumstances that is not necessary to respond to your enquiry.

Purposes and legal bases

We process your personal data for the following purposes:

• to respond to your enquiry and to communicate with you;
• where applicable, to prepare a client relationship;
• to provide the Website and to protect it against misuse, spam and attacks;
• to comply with legal and regulatory obligations, such as record-keeping requirements.

Where the EU General Data Protection Regulation (GDPR) applies, we process your personal data because this is necessary to respond to your enquiry or to prepare a potential business relationship, because we have a legitimate interest in a secure and properly functioning Website, or because we are required to do so by law.

Hosting and data storage location (Israel)

The Website is hosted by a provider in Israel. Server log files and information submitted via the contact form are therefore stored on servers in Israel. The hosting provider processes this data exclusively on our behalf and in accordance with our instructions.

Israel is recognised as providing an adequate level of data protection both by the Swiss Federal Council (Annex 1 to the Data Protection Ordinance, DPO) and by an adequacy decision of the European Commission. The disclosure of your data to Israel is therefore permitted without additional safeguards.

Enquiries submitted via the contact form are also forwarded by email to our mailbox info@profit-zurich.ch. Our emails are stored in Switzerland.

Google reCAPTCHA

To protect the contact form against spam and automated access, we use Google reCAPTCHA, a service provided by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland, and Google LLC, USA. reCAPTCHA uses various characteristics, such as the IP address, browser and device information and user behaviour on the Website, to determine whether an entry was made by a human or by an automated program. For this purpose, data may be transferred to Google servers in the USA.

Google LLC is certified under the Swiss-U.S. Data Privacy Framework and the EU-U.S. Data Privacy Framework. An adequate level of data protection is therefore ensured for this transfer under both Swiss and EU law. Further information can be found in Google’s Privacy Policy.

Disclosure to third parties

We do not sell your personal data and disclose it only where this is necessary for the purposes described above. Recipients may include:

• service providers processing data on our behalf, for example for hosting, IT operations and email; they are contractually bound to confidentiality and data protection;
• authorities, courts and supervisory bodies, where we are legally obliged to disclose data.

Data security

We take appropriate technical and organisational measures to protect your personal data against loss, misuse and unauthorised access. The connection to the Website and the transmission of information via the contact form are encrypted (SSL/TLS). However, complete security of data transmission over the internet cannot be guaranteed.

Retention period

We retain personal data only for as long as necessary for the purposes described above or as required by statutory retention obligations. As a rule, we delete information from contact enquiries no later than 12 months after the enquiry has been concluded, unless a client relationship is established. Server log files are deleted after 90 days.

Cookies

Cookies are small text files that are stored on your device when you visit a website. Our Website does not use analytics, advertising or tracking cookies. Only the following cookies, which are strictly necessary for the operation and security of the Website, are used:

As only strictly necessary cookies are used, we do not use a cookie management tool, and there are no optional cookies for you to disable. You can delete or block cookies at any time in your browser settings. Please note that the contact form may not be submitted without the reCAPTCHA cookie.

No automated individual decision-making and no profiling

We do not engage in automated individual decision-making or profiling.

Your rights

Subject to applicable data protection law, you have in particular the following rights:

• Access to information on whether and which personal data we process about you;
• Rectification of inaccurate or incomplete data;
• Erasure of your data, unless statutory retention obligations apply;
• Restriction of processing;
• Data portability in order to receive or have your data transmitted in a commonly used electronic format;
• Objection to processing based on our legitimate interests;
• Withdrawal of any consent given, with effect for the future.

You also have the right to lodge a complaint with the Swiss Federal Data Protection and Information Commissioner (FDPIC, www.edoeb.admin.ch) or, where the GDPR applies, with a competent supervisory authority in the EU.

Changes to this Privacy Policy

We may amend this Privacy Policy at any time, for example in the event of new Website features or changes in legal requirements. The version published on the Website at any given time shall apply.
